This agreement constitutes a contract between (Renter) and John & Michelle Pollock of the vacation rental property Gulf Shores Escape at Seawind Condominium 500-SW3. By signing this agreement, you and your guests are agreeing to all the terms and conditions listed in the rental agreement. Your vacation rental is a transient rental under state law. This means that your tenancy is temporary for the stated time period only. At no time is the property to be sublet or assigned to another individual. Please do not make any repairs, alterations, or improvements in or about the property.
Unfortunately, we cannot accommodate college or high school groups. The guest that is over 25 years of age and signs this rental agreement must be present the entire stay.
SECURITY DEPOSIT: A security deposit in the form of a credit card on file or a separate $300.00 deposit check. If damage exceeds the security deposit, you agree to pay any and all damage charges above the security deposit with the credit card on file. The property is inspected before and after every tenancy. While you are here, we ask your cooperation in reporting any damage. Your security deposit will be fully refunded after your departure, providing the following provisions were met: (1) no smoking; (2) no pets; (3) all check-out procedures were followed; (4) no damage to the property or its contents beyond normal wear and tear; and (5) the number of guests did not exceed the agreed upon number of occupants (8 guests).

No Daily Housekeeping: There is no daily housekeeping service. While linens and bath towels are included with the property, daily maid service is not included in the rental rate.
NO SMOKING: Smoking in the condo will automatically incur an additional $500.00 cleaning fee. (Smoking on the balcony with the doors closed is fine)
NO PETS: Pets are not allowed in or on the property. The presence or evidence of a pet on the property will cause forfeiture of the entire rent and immediate tenant eviction. An additional cleaning fee will be charged.
CANCELLATIONS/REFUNDS: Please notify us immediately if you are unable to keep your reservation. All cancellations are subject to a $175.00 cancellation fee. Weekly or less rentals with written notice of less than sixty (60) days will cause a loss of paid rent unless the condo is re-rented for the same time period. Monthly rentals with written notice of less than ninety (90) days will cause a loss of paid rent unless the condo is re-rented for the same time period. No refunds are given for early departures. Units may not be sublet.
I agree with the dates, pricing, policies and procedures. I understand and agree that the reservation dates requested are not reserved/blocked until the rent deposit has been received by John Pollock; Gulf Shores Escape. I understand and agree that the reservation dates requested must be paid in full thirty (30) days in advance of arrival. I understand if damage (including smoking) occurs to the condo or contents, I am financially responsible for any said damage.
CONDITIONS BEYOND OUR CONTROL: We are not liable for events beyond our control which interfere with your scheduled occupancy, including, but not limited to: acts of God, acts of governmental agencies, fire, strikes, war, tornado, hurricanes, tropical storms, ice storm, severe weather, inclement weather, ferry boat cancellation, loss of electricity, or loss of water. There will be no refund in these circumstances. We recommend you purchase travel insurance prior to arrival.
CRIMINAL ACTIVITY: You agree to not engage in any criminal conduct on the property, including but not limited to the following: usage of illegal drugs, committing a felony, violating any law or ordinance, disturbing the peace, engaging in conduct for unlawful purposes. We are not liable for any damage or injury you cause to yourself or a 3rd party while engaging in criminal activity.
INDEMIFICATION: We shall not be liable for any damage or injury suffered by you, your family, guests, invitees, agents or employees or to any person entering the property. You agree to indemnify, defend and hold us harmless from any and all claims or assertions of every kind and nature.
GOVERNING LAW: This agreement shall be governed, construed, and interpreted under the Laws of the State chosen by us.
SEVERABILTY: If any part of this agreement is held to be invalid, such invalidity shall not affect the validity or enforceability of the rest of this agreement.
FALSIFIED RESERVATION: If you provide false information concerning your identity or other aspects of the reservation, you will automatically forfeit the reservation and will not be granted access to the property. In addition, you will not be refunded any money paid in advance. We have a right to report the fraud to appropriate authorities.
ARRIVAL INSPECTION +DAMAGE: Please complete an arrival inspection on your day of arrival and report any broken items, damage or issues to us immediately. Any damages that occur during your stay must be reported immediately to us. In the event that damage occurs to the property, whether reported by you or found after departure, the cost of repair and/or replacement will be held from the deposit or credit card on file. If the amount of repair and/or replacement exceeds the deposit amount, you will be responsible for any additional costs. Additional costs for repair or replacement will be charged to the credit card on file.
TRAVEL PROTECTION INSURANCE: Travel Insurance is available through Travel Guard Travel Protection and can be purchased up until fourteen (14) days prior to arrival or time of final payment. This is an optional plan, but we strongly recommend it. In case of any unforeseen events, this insurance helps protect your vacation investment. .Questions in regard to Travel Guard Travel Protection can be obtained by calling 1.800.826.4919 or reviewing the certificate of insurance on their website at www.travelguard.com.
CHECK-IN PROCEDURES: Check in is after 4 PM. I will provide you an electronic entry key code, pool access wrist band & one (1) parking passes – up to 3 are available at $25.00 each
CHECK-OUT PROCEDURES: Check-out time is 10:00 AM on the day of departure (leave parking passes under the owners’ closet next to the refrigerator & pool bands in the bowl on the counter.) If you check-out after 10:00 AM, you will incur an additional one day rental.
HURRICANE POLICY: If a mandatory evacuation is issued by the National Hurricane Center or our local governing officials due to a tropical storm or hurricane threatening our area, refunds will only be given by Travel Guard Travel Protection if you have purchased coverage before the storm was named. Gulf Shores Escape will not issue refund of any rent payments.
FURNISHINGS & EQUIPMENT: You are renting our privately owned condo. It has been decorated and equipped to satisfy our particular tastes and desires. Please be considerate of our belongings and to the people who will be renting the Penthouse after you. Please do not rearrange the furniture, take any items outside that are part of the interior décor or move any furnishings or kitchen items to another property.
You will be charged if the housekeepers have to rearrange the furniture after your stay.
Renter is to indemnify Gulf Shores Escape for any damages or costs to the premises, furnishings, equipment, and household items therein, which occur during renter’s occupancy excluding normal wear and tear.
Locked closets are maintained for our personal use. Please respect these areas. If owners closets are found broken into, there will be a charge for repair of lock and replacement of any missing items.
REPAIRS: We are available to make sure your vacation home is in the best condition that it can be. If you should discover otherwise, please report it to us immediately and we will correct it as quickly as possible; however no refunds will be given for appliance failure or other circumstances beyond our control.
LOCKOUTS: If you lock yourself out of your property call (850) 525-4469.
GRILLING: Management prohibits charcoal or open fire grilling on or under decks, balconies or porches, or within ten (10) feet of any structure. Please check property for designated grilling area. (A charcoal grilling area is available)
ITEMS LEFT IN PROPERTY: Gulf Shores Escape is not responsible for personal items left in the property.
OCCUPANCY: The total number of persons allowed in the property at any time is restricted to the stated limit for each property. Eviction without refund is the penalty. We are very serious about maintaining a family atmosphere for the quiet enjoyment of all our guests. We will rent to family groups and responsible adults only. Gulf Shores Escape will not be rented to anyone under 25 years of age. No children will be allowed to check-in without their parents. Reservations made under false pretense will be subject to forfeit of entire advance payment. Identification may be required upon check-in to verify age.
INDEMNITY: Gulf Shores Escape will not be liable for any damages to rental property of furnishings nor for injuries resulting from any accident that may occur in or on the premises during the guests’ occupancy. Gulf Shores Escape will not be held responsible for acts of theft or vandalism or other damages to the guests’ personal items left in the unit or vehicle.

Depending on the time of year Seawind Condominiums may prohibit boats, trailers, jet-skis, motor homes and buses. If traveling with any of these, please call in advance, 850-525-4469
MAINTENANCE
We make every effort to keep our penthouse in top condition. Notify us immediately of any maintenance problem and we will strive to repair it as soon as possible. No refund or adjustment will be made for mechanical failures.
Parking Passes/Wristband – You may park directly in front of the small Amenities Luxury Suites or in the Tower Condo parking garage. Parking passes and wrist bands should be visible at all times. When your stay is complete, please slide the parking passes under the owners’ closet (next to the refrigerator). Leave the wrist bands in the bowl on the counter or mail them to John Pollock, 6410 Guilford Drive, Pensacola FL 32504
Pool Hours and Rules – Hours are from 8:00am-11:00pm. Children under 14 must be accompanied by an adult. DO NOT take glassware to the pool area. Swim at own risk. John & Michelle Pollock, Seawind Condo., Association, or Gulf Shores Escape is not responsible for injury or accidents.
Fitness Center – ACCESS CODE TO FITNESS CENTER Hours: 7:00am-10:00pm. Children under 16 must be accompanied by an adult. Proper workout attire is required including tennis shoes.
Balcony – Do not grill, feed seagulls, hang towels or bathing suits from the balcony. Do not lean or throw anything over the balcony (It is a felony in Gulf Shores/Orange Beach to throw anything from a balcony).
Garbage & Garbage Disposal – Garbage dumpsters are located on the bottom floor of the Tower Condo parking garage. Please avoid placing shrimp shells or hard objects in the garbage disposal. Seafood shells make for a terrible odor for you as well as the next guest.
Check-Out Procedures – Slide parking passes and wrist bands under the owners’ closet door next to the refrigerator. Take all trash to the dumpsters located in the Tower Condo parking garage. Remove all items from the refrigerator and cabinets. Clean and put away dishes. If any furniture was moved return it to its original position. Double check all drawers and cabinets to ensure no personal goods are left behind. Strip beds and put sheets and pillows cases in the hallway.

CHECK-IN PROCEDURES: Check in is after 4 PM. I will provide you an electronic entry key code, pool access wrist band & one (1) parking passes – up to 3 are available at $25.00 each
CHECK-OUT PROCEDURES: Check-out time is 10:00 AM on the day of departure (leave parking passes under the owners’ closet next to the refrigerator & pool bands in the bowl on the counter.) If you check-out after 10:00 AM, you will incur an additional one day rental.
HURRICANE POLICY: If a mandatory evacuation is issued by the National Hurricane Center or our local governing officials due to a tropical storm or hurricane threatening our area, refunds will only be given by Travel Guard Travel Protection if you have purchased coverage before the storm was named. Gulf Shores Escape will not issue refund of any rent payments.
FURNISHINGS & EQUIPMENT: You are renting our privately owned condo. It has been decorated and equipped to satisfy our particular tastes and desires. Please be considerate of our belongings and to the people who will be renting the Penthouse after you. Please do not rearrange the furniture, take any items outside that are part of the interior décor or move any furnishings or kitchen items to another property.
You will be charged if the housekeepers have to rearrange the furniture after your stay.
Renter is to indemnify Gulf Shores Escape for any damages or costs to the premises, furnishings, equipment, and household items therein, which occur during renter’s occupancy excluding normal wear and tear.
Locked closets are maintained for our personal use. Please respect these areas. If owners closets are found broken into, there will be a charge for repair of lock and replacement of any missing items.
REPAIRS: We are available to make sure your vacation home is in the best condition that it can be. If you should discover otherwise, please report it to us immediately and we will correct it as quickly as possible; however no refunds will be given for appliance failure or other circumstances beyond our control.
LOCKOUTS: If you lock yourself out of your property call (850) 525-4469.
GRILLING: Management prohibits charcoal or open fire grilling on or under decks, balconies or porches, or within ten (10) feet of any structure. Please check property for designated grilling area. (A charcoal grilling area is available)
ITEMS LEFT IN PROPERTY: Gulf Shores Escape is not responsible for personal items left in the property.
OCCUPANCY: The total number of persons allowed in the property at any time is restricted to the stated limit for each property. Eviction without refund is the penalty. We are very serious about maintaining a family atmosphere for the quiet enjoyment of all our guests. We will rent to family groups and responsible adults only. Gulf Shores Escape will not be rented to anyone under 25 years of age. No children will be allowed to check-in without their parents. Reservations made under false pretense will be subject to forfeit of entire advance payment. Identification may be required upon check-in to verify age.
INDEMNITY: Gulf Shores Escape will not be liable for any damages to rental property of furnishings nor for injuries resulting from any accident that may occur in or on the premises during the guests’ occupancy. Gulf Shores Escape will not be held responsible for acts of theft or vandalism or other damages to the guests’ personal items left in the unit or vehicle.

Depending on the time of year Seawind Condominiums may prohibit boats, trailers, jet-skis, motor homes and buses. If traveling with any of these, please call in advance, 850-525-4469
MAINTENANCE
We make every effort to keep our penthouse in top condition. Notify us immediately of any maintenance problem and we will strive to repair it as soon as possible. No refund or adjustment will be made for mechanical failures.
Parking Passes/Wristband – You may park directly in front of the small Amenities Luxury Suites or in the Tower Condo parking garage. Parking passes and wrist bands should be visible at all times. When your stay is complete, please slide the parking passes under the owners’ closet (next to the refrigerator). Leave the wrist bands in the bowl on the counter or mail them to John Pollock, 6410 Guilford Drive, Pensacola FL 32504
Pool Hours and Rules – Hours are from 8:00am-11:00pm. Children under 14 must be accompanied by an adult. DO NOT take glassware to the pool area. Swim at own risk. John & Michelle Pollock, Seawind Condo., Association, or Gulf Shores Escape is not responsible for injury or accidents.
Fitness Center – ACCESS CODE TO FITNESS CENTER Hours: 7:00am-10:00pm. Children under 16 must be accompanied by an adult. Proper workout attire is required including tennis shoes.
Balcony – Do not grill, feed seagulls, hang towels or bathing suits from the balcony. Do not lean or throw anything over the balcony (It is a felony in Gulf Shores/Orange Beach to throw anything from a balcony).
Garbage & Garbage Disposal – Garbage dumpsters are located on the bottom floor of the Tower Condo parking garage. Please avoid placing shrimp shells or hard objects in the garbage disposal. Seafood shells make for a terrible odor for you as well as the next guest.
Check-Out Procedures – Slide parking passes and wrist bands under the owners’ closet door next to the refrigerator. Take all trash to the dumpsters located in the Tower Condo parking garage. Remove all items from the refrigerator and cabinets. Clean and put away dishes. If any furniture was moved return it to its original position. Double check all drawers and cabinets to ensure no personal goods are left behind. Strip beds and put sheets and pillows cases in the hallway.
