RESERVATION DEPOSIT AND PAYMENT: To confirm your reservation a bank transfer, check, credit card or money order payment must be received in the amount of 25% of the total rent in US Dollars. Ninety days (90) or more prior to your arrival the remaining balance must be paid in full. Reservations made within ninety (90) days prior to arrival date will require full immediate payment. Late payments will have a charge of $4.00 per day and after 7 days late you will forfeit your deposit and the rental agreement may be cancelled.
SECURITY DEPOSIT: IS REQUIRED for breakage or other major damage with
exception to normal wear that may occur during your stay. We authorize Gary Ellis to process or submit a charge to my credit, debit card or cash on deposit for the estimated charges of repair of damages to this rental unit. Charges for any damage or loss will be applied after a home inspection has been completed by management and submitted in writing to renter and owner by either e-mail or post mail. (You can ask for inspection report by management prior to and after rental stay).
Late check-out without owner’s written approval well have a deduction from there security deposit. The first half hour $75.00 and it will double each half hour afterwards.
CANCELLATIONS BY RENTER: Made ninety-one (91) days or more prior to arrival
date are refundable at 75% of the full rent amount, ninety (90) days through sixty-one (61) days or more prior to arrival date are refundable at 60% of the full rental amount, sixty (60) days through forty-six (46) days prior to your arrival date will be refundable at 40% of the full rent amount, forty-five (45) days through thirty one (31) days prior to your arrival date will be refundable at 20% of the full rent amount, thirty (30) days or less prior to arrival date are refundable at 0% of the full rental amount.
Date changes may be accepted ninety-one (91) days or more prior to your arrival date subject to approval of owner with open vacancy of proposed date, a charge of $150.00 dollars will apply if approved. Any and all cancellations or changes MUST be informed in writing.
CANCELLATIONS BY OWNER: In the event of circumstances beyond our control
requiring us to cancel a reservation i.e. including Acts of God, civil disturbances, riots, drought, fire, ownership transfer, legislation, hurricanes, tornado, earthquake, flood and etc. The owner will not responsible for any of the following:
Finding alternate lodging for the renter
Renter’s financial losses or liability whatsoever related to transportation, alternate lodging or any loss of damages sustained by the renters in these circumstances.
If, on the day that the rental is scheduled to begin, the property is uninhabitable, or the property is not reachable by the usual means of transportation, or access to the property by the renters has been prohibited by authorities, then the owner should refund all money paid by the renters for the vacation rental, including any deposit and prepaid rent.
If renters (visitor) are required by local authorities to evacuate the area, and actually do so before their stay in a vacation rental is completed, then the owner should refund a pro rated portion of the unused rent paid by the renters for the vacation rental, plus any deposit. For example, if $700.00 has been paid for seven nights, and the renters are ordered to evacuate one night earlier than they were scheduled to depart, then the refund would be $100.00 and there would be no deduction from the deposit for damages that could have been caused by the catastrophe.
SMOKING: Is not permitted anywhere inside the villa. Smokers are welcome to smoke on outside only.
VILLA OCCUPANCY: The villa is licensed by Osceola County Florida for a maximum occupancy of 14 persons, including children and babies. Only those persons named on the Rental Agreement are permitted residency of the villa for all or part of the rental period. Any persons occupying the villa overnight and not shown on the booking agreement will be requested to leave the premises unless approved by the Management Company or owner in advance.
SWIMMING POOL & SPA: The property has a private swimming pool and spa. The
Owner DOES NOT accept any liability for any injury caused as a result of the use of the pool or spa Guests are specifically requested not to allow unsupervised children to use the pool or spa. “You swim at your own risk”. There are no life guards; you are your own lifeguard, so swim with care. Anyone with health or heart conditions like high blood pressure DO NOT USE THE SPA. Heat must be requested in advance.
PERSONAL SAFETY: The Owner cannot accept any liability for your personal safety during your residency of the villa. Guests are reminded to exercise care as to the personal safety of themselves and all party members. Whenever possible, valuables should be left secure and out of sight.
POOL HEATER: Our pool water is heated by a heat pump that runs with the pool filter system for about 10 hours per day. The pool water temperature is set at about 84 degree maximum water temperature. If the outside temperature drops below 48 degrees the pool heat pump will not start until the outside temperature gets over 50 degrees.
SPA HEATER: Our spa water is heated by an extra heat pump that must be turned on by an hour timer on the exterior wall and works the same as the pool heat pump. There is also a heat or fill white 4 inch value located just outside of the pool enclosure screen.
INSECTS: Florida is a tropical state and as such insects and small creatures are inevitable and are not a cause for complaint. Their presence is no reflection on the cleanliness of the property. The home is treated regularly as part of a pest and termite control program. We advise you to keep all windows and external doors closed whenever possible. This help to
keep bugs from the property, but it also enable the air conditioning unit to function more efficiently.
ITEMS LEFT BEHIND: We will not be responsible for any personal items left in a unit. If requested to pick-up and mail items to you, a C.O.D. charge plus handling fee will be required.
PARKING RESTRICTIONS: Due to the deed restrictions of our resort parking areas are for automobiles and passenger vans only. Motor homes, travel trailers, construction trailers, boat trailers, are NOT permitted in this community.
REPAIRS: Should air conditioners, appliances, etc. malfunction, every effort will be made to have them repaired as quickly as possible, but we cannot guarantee that an interruption of service will not occur. No rebate or refund will be given for circumstances beyond our control including inclement weather. Service requests called in after 5 PM will be handled as soon as possible but may not be handled until the following business day. Non-emergency weekend maintenance requests will be taken care of on Monday during normal office hours.
ROUNTINE MAINTENANCE: From time to time, it may be necessary for us to enter the vacation home during reasonable hours for any purpose connected with the repair, care, and general maintenance of the unit. We will try to notify you in advance whenever possible.
HOUSEKEEPING: Your vacation home is professionally cleaned upon your departure. Should additional service be required due to negligence or abuse a minimum charge of $50 will be assessed against your security deposit. If an interruption of our housekeeping schedule is caused by a guest checking-out after the 10:00 am check-out time, an extra cost may be assessed against your security deposit.
TELEPHONES: The phone is free for all local and USA calls. All others a major credit card or calling card is needed to place any long distance calls out of the USA.. Please refer to the instructions posted in the unit.
PETS: Sorry, no pets allowed in or at the property. You will be requested to vacate premises without refund if pets are brought.
PROBLEMS OR COMPLAINTS: In the unlikely event that you experience any
problems with the property please contact Management Team Gary Ellis 1-586-354-7379, or our onsite person (Simply Management) 407-802-0749 who will do their best to rectify the matter as soon as is practically possible. Should a problem remain unresolved, the owner must be notified immediately.
Every effort has been made to ensure the accuracy of descriptions concerning the property and services. However, we cannot be held responsible for any errors, omissions and changes beyond our control.
Gary Ellis, agents or owners of the individual Rental unit shall not be liable for any damage or injury to tenant or to any other person (s), guest (s), or to any property occurring on the premises or any part thereof; and tenant agrees to hold agent and owners harmless for any claims for damage, no matter how caused. Agents or owners will not be held responsible for acts of theft or vandalism or other damages to tenants' personal property (or guests).
